I, _________________________, hereby acknowledge and agree to the following terms and conditions before participating in any movement-based classes, workshops, or related activities (hereinafter “Activities”) offered by The Curvy Experience, LLC, including but not limited to pole dance, yoga, stretch, dance fitness, or other physical wellness sessions.

1. Assumption of Risk

I understand that participation in movement-based Activities involves inherent physical risks, including but not limited to slips, falls, muscle strains, joint injuries, cardiovascular stress, and equipment-related injuries. I voluntarily choose to participate with full knowledge of these risks and accept responsibility for any injury, loss, or damage that may occur. I release The Curvy Experience, LLC, its owners, instructors, independent contractors, employees, and affiliates (collectively, “Released Parties”) from any liability for such risks.

2. Physical Condition & Medical Clearance

I affirm that I am in good physical condition and free from any condition, impairment, disease, or other illness that would prevent my safe participation. I understand it is my responsibility to consult a physician regarding any medical conditions and to inform the instructor of any limitations or accommodations needed before participating.

3. Release of Liability

In consideration of being permitted to participate in the Activities, I hereby waive, release, and discharge the Released Parties from any and all claims, demands, actions, or causes of action for any injury, loss, or damage to person or property, including but not limited to those arising from the negligence of the Released Parties, to the fullest extent allowed under Pennsylvania law.

4. Indemnification

I agree to indemnify and hold harmless The Curvy Experience, LLC and all Released Parties from any claims, judgments, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of my participation or conduct in the Activities.

5. Student Conduct

I agree to behave respectfully and responsibly during all classes and events. Disruptive, harassing, unsafe, or inappropriate behavior toward instructors, participants, or studio property may result in my removal from a class or permanent suspension without refund. The Curvy Experience, LLC reserves the right to make this determination in the interest of safety and community wellbeing.

6. Photography & Videography Consent

I understand that classes or events may be recorded or photographed for promotional, marketing, or educational purposes by The Curvy Experience, LLC.

☐ I DO NOT consent to the use of my image, voice, or likeness for any media or promotional purposes.
(If checked, The Curvy Experience, LLC will make reasonable efforts to exclude me from recordings, but full exclusion from group media cannot be guaranteed.)

7. Pennsylvania Law & Severability

This agreement shall be governed by the laws of the Commonwealth of Pennsylvania. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Acknowledgment of Understanding

I have read this entire Waiver of Liability and Assumption of Risk Agreement. I understand its terms, and I sign it voluntarily and without inducement. I acknowledge that I am giving up substantial legal rights, including the right to sue.
